Terms of Service

Effective date: [EFFECTIVE DATE]

These are the terms for using Ayika. Please read them. By signing in, or by chatting with Ayika on WhatsApp or Telegram, you agree to them. If you don’t agree, please don’t use Ayika.

Ayika is run by [COMPANY LEGAL NAME] (RC [RC NUMBER]), registered at [REGISTERED ADDRESS]. In these terms, “we”, “us” and “Ayika” mean that company.

What Ayika is

Ayika is a platform that matches people who need a job done with providers who do that kind of work, such as plumbers, electricians and cleaners. You describe what you need. We find providers near you and send them your request.

We are not the provider. Providers are independent people and businesses. They are not employees, agents or partners of Ayika. The work is an agreement between you and the provider. We don’t do the work, supervise it, or promise how well it will be done. We also can’t promise that a provider will accept your request or turn up.

Who can use Ayika

You must be at least 18 years old. You must give true information about yourself. If you use Ayika for a business, you confirm you are allowed to do so.

Your account

You sign in with your phone number and a one-time code. We send the code by WhatsApp, Telegram or SMS. On WhatsApp and Telegram, messaging us from your own account can also sign you in. You can add an email address and a profile photo if you want to.

Keep your phone and your chat accounts safe. What happens under your account is your responsibility. Tell us at [CONTACT EMAIL] if you think someone else is using it.

One person can be both a customer and a provider. You can’t accept your own request.

You can delete your account in Settings. See “Ending your account” below.

Fees and payments

There are two payments on a job.

The commitment fee. When a provider accepts your request, you pay a commitment fee online. The job can’t start until you pay it. We show you the amount before you pay. We work it out when the provider accepts and it does not change after that. Part of it goes to the provider when the job is completed.

The service fee. This is the price for the work. You can pay it by card through Ayika, or pay the provider directly, where we allow that. When you pay by card, we hold the money until the job is complete, then release it to the provider. When you pay directly, the provider confirms they got it, and the amount Ayika is owed from that job is recorded as a debt the provider owes us.

Card payments are handled by Paystack. Paystack’s own processing fee may be added at checkout. We don’t add anything on top of it. Amounts are shown in naira.

Providers can see what they have earned and what they owe us. They can ask for payouts to their bank account.

Cancelling and refunds

You can cancel a request. What happens to your money depends on when.

  • If you cancel before the provider taps “on my way”, your commitment fee is refunded in full.
  • If you cancel after the provider is on the way, the provider keeps the commitment fee.
  • If the job is cancelled or fails for another reason, such as no provider being available, your commitment fee is refunded.
  • If the provider cancels, we may carry your commitment fee over to the next provider for a short time. If you would rather not wait, you can take the refund.
  • A service fee you paid by card is refunded if the job is cancelled or fails.

Refunds go back to the way you paid. They can take a few days to show up, depending on your bank.

A provider can also cancel or decline a job. Providers who cancel often may be flagged and reviewed.

How you should behave

Don’t use Ayika to scam, threaten, harass or hurt anyone. Don’t post anything unlawful. Don’t give false requests or false ratings. Don’t try to get around Ayika’s fees by taking a job off the platform after we have matched you. Don’t try to break, probe or overload our systems, or use someone else’s account.

Be respectful to the people you meet through Ayika. Providers go into people’s homes, and customers let them in. Both sides should feel safe.

Ratings, reports and safety

After a job, you can rate the provider. Ratings should be honest and about the job.

You can report a problem from a job. Reports can be about a scam or about violence. Our staff review them. If a report says someone has been violent, we may pause the reported person from getting new jobs straight away, until we have looked into it.

We may suspend or remove an account, close open offers, or refuse a job if we believe these terms have been broken, if someone may be at risk, or if the law requires it. Where we can, we will tell you why.

If you are a provider

By signing up as a provider, you also agree to the following.

  • You are an independent business. You are responsible for your own tools, taxes, insurance and permits, and for doing the work safely and properly.
  • Your business name, description, services, areas and hours must be true. You decide which requests to accept.
  • You may send an ID document so we can verify you. Where we ask for verification, we may stop sending you requests until you are verified. Only Ayika staff can open your ID.
  • You must not take a customer’s commitment fee or service fee outside Ayika, except where the customer chooses to pay you directly for the service fee. If you are paid directly, confirm it in the app.
  • You owe Ayika its charge on jobs paid directly. It shows as a debt on your account, and you pay it down in the app.
  • Be honest about whether you are on your way, started or finished, because refunds depend on it.

Our rights over the service

Ayika, its name and its software belong to us. You may use them only as these terms allow. You keep the rights to what you send us, such as requests, photos and voice notes. You give us permission to use them to run Ayika: to understand your request, to share what’s needed with the provider, and to handle reports and disputes.

Messages from us

We send you messages about your account and jobs on WhatsApp, Telegram, SMS and email, depending on how you reached us and what you’ve chosen in your settings.

Our responsibility to you

We try to keep Ayika running and accurate, but we can’t promise it will always be available or free of errors. Matching can fail, and messages can be delayed.

Because providers are independent, we are not responsible for the work they do or fail to do, for damage to your property, for injuries, or for what a provider or customer says or does. Work out any problem with the provider first. Report it to us if it is serious, and we will help where we can.

To the extent the law allows, our total responsibility to you for any claim connected to Ayika is limited to the fees you paid to Ayika for the job the claim is about. We are not liable for indirect or consequential losses, such as lost income or lost opportunities. Nothing in these terms limits liability that can’t be limited by law, including for fraud or for death or personal injury caused by our negligence. Nothing here takes away your rights under Nigerian consumer protection law.

Ending your account

You can delete your account from Settings at any time. You may be asked to finish open jobs and settle balances first. You are signed out everywhere straight away. After 30 days, we remove or anonymise your personal details. Requests, chats and ratings that involve other people stay, but they show “Deleted user” instead of your name. Our Privacy Policy explains what we keep and why.

We can also end or suspend your account as described above.

Changes to these terms

We may change these terms. When we do, we will update the date at the top and, for changes that matter, tell you in the app or by message. If you keep using Ayika after a change takes effect, you accept it. If you don’t, you can delete your account.

Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria. Please contact us first at [CONTACT EMAIL] and we will try to sort things out. If we can’t, the courts of Lagos State have jurisdiction over any dispute.
